Drafting notes — delete before publishing
- This is the long-form draft. The live page,
apps/website/app/terms/page.tsx, is shorter and is what applies (live since 2026-10-07); the two have not been reconciled (gap-log G60). This draft has sections the page lacks (customer responsibility for lists and consent as its own section, the enforcement ladder, fair-use limits); the page carried a transfer clause that the draft lacked until now (§16).- Governing law: India, with the courts in Azamgarh, Uttar Pradesh (the operator's home district), decided by the owner on 2026-10-07. The earlier published version named Bengaluru, which had no link to the operator. Counsel should confirm the venue clause.
- Refunds: decided 2026-10-07: within 7 days of a payment, on request by email, the payment minus the credits used. There is no refund flow in the code (the manager only observes refunds made in the payment dashboard), so it is done by hand (gap-log G71).
- §13 deletion wording is gated (checked 2026-10-05). The earlier "exportable for 30 days, archived for 60" was not true: cancelling a plan deletes nothing, and deleting a workspace only sets a flag (it hides the workspace; no data is removed and no export is possible afterwards). The bracketed sentence in §13 ("erased 90 days after deletion") may be published only after the workspace-purge pipeline ships (gap-log E2 and E3). Until then §13 says "email us; within 30 days we tell you what we erased and what we could not". Deleting a workspace now also cancels its plan and add-ons (data-lifecycle S4, deployed 2026-10-27, gap-log G26), and §13 says so on the live site since the same day.
- §6 says high bounce or complaint rates "can pause sending automatically". The breaker is built but only records and warns until
REPUTATION_ENFORCE=true. It is worded as a right ("may"), which is true; do not turn it into a promise until it is enforcing (gap-log G68).- §8 states the limits that exist (3,600 emails an hour per campaign, 100,000 recipients per campaign). It no longer lists a first-campaign review or daily caps, which do not exist (Phase B).
- Counsel review before publishing. Not legal advice.
Effective 7 October 2026. These terms are between you and Dipanshu Vishwakarma, trading as Vlozi, Devgaon, Azamgarh, Uttar Pradesh 276201, India ("Vlozi", "we", "us"), who operates the website at vlozi.app and the product at go.vlozi.app. By creating an account or using Vlozi you agree to them.
1. Who we are and who can use Vlozi
Vlozi is operated by Dipanshu Vishwakarma, trading as Vlozi, Devgaon, Azamgarh, Uttar Pradesh 276201, India. You can reach us at hello@vlozi.app.
You must be at least 18, or have a guardian's permission and supervision. If you use Vlozi for a company or other organisation, you confirm you have the authority to bind it to these terms, and "you" includes that organisation.
2. Your account
Keep your credentials private. You are responsible for what happens under your account, including content published and email sent through API keys you create. If a credential is compromised, rotate it in the dashboard and email security@vlozi.app. Give us accurate account information and keep it up to date; we send account and billing notices, and alerts, to the email on your account.
3. Credits, plans and packs
- Vlozi is billed in credits. Subscription plans refill credits each month; pack credits are bought once and do not expire.
- When you spend, subscription credits are used first so pack credits are left untouched.
- Upgrades take effect immediately and add credits that day. Downgrades take effect at the next cycle.
- Subscription refunds: within 7 days of a payment, email hello@vlozi.app and we refund that payment minus the credits you have used. Pack credits are non-refundable, but they do not expire.
- If you run out of credits mid-cycle, your blog and published pages stay live. Anything that spends credits (sending email, chatbot replies, AI features, social posts) stops until you add more.
- Prices, taxes and the credit cost of each action are shown in the product at the time you buy or use them.
4. Using Vlozi
You may use Vlozi for your own business or as an agency for your clients, within these terms. An agency sends from its own workspace and is responsible for its clients' lists, consent and content. You may not:
- resell Vlozi, or provide it to others as a white-label or competing service, without a written agreement with us;
- reverse engineer or probe the service for vulnerabilities outside our security-reporting process;
- use it in a way that breaks the law or the Acceptable Use Policy.
5. Your content
- You own what you create on Vlozi: posts, newsletters, contacts, prompts, uploaded media.
- You give us the licence we need to host and deliver it: to store it, serve it, process it to provide the features you use, and send it as email on your instruction.
- We do not train or fine-tune models on your content. When a feature uses an AI model, only the content needed for that request is sent to the provider named in the sub-processors list, and that provider's API terms apply to it.
- We own the platform, brand, code and design. Ask before using the Vlozi name or marks in your own materials.
6. Email, lists and consent — your responsibilities
When you use Vlozi to send email (newsletters, notifications, replies, automations), you are the sender and you are responsible for the recipients, the content and compliance with the law. In particular, you promise that:
- you have lawful consent (or another lawful basis that the applicable law accepts) to email every recipient, and you can show it if asked: when, how and to what they agreed;
- you will not email purchased, rented, scraped, harvested or third-party lists;
- every marketing message has a working unsubscribe link and your real postal address, as set out in the Anti-Spam Policy;
- you honour unsubscribes and suppressions promptly, and do not re-add an address that has unsubscribed, bounced or complained;
- you comply with the laws that apply to your messages and your recipients, including (as relevant) CAN-SPAM, GDPR and ePrivacy rules, India's Digital Personal Data Protection Act, and the rules of any country you send to.
As between you and us, you are the controller of the personal data of the people you email, and we process it on your behalf; see the Privacy Policy.
We may review, limit, delay or refuse sending that appears to break this section, to protect recipients and the shared sending reputation that every customer depends on. Complaint and bounce rates above our thresholds may lead us to pause sending.
7. Enforcement
If you or your account break these terms, the Acceptable Use Policy or the Anti-Spam Policy, we may, in proportion to the problem and with notice where we can:
- warn you and ask for a fix;
- limit or pause sending, publishing or particular features;
- suspend the account;
- terminate the account, without refund for serious or repeated violations.
We may act immediately, and without notice, where there is a risk to people, to other customers, to our infrastructure or to our ability to send email, or where the law requires. If you think we got it wrong, email hello@vlozi.app with your account and the reason; we will look at it and reply.
8. Fair use and limits
Plans and credits set what you can do. Sending is paced (3,600 emails an hour per campaign by default) and a campaign is capped at 100,000 recipients. We may change these limits, and apply others (rate limits, size limits), for a workspace to keep the service reliable and safe for everyone. We describe limits that affect you in the product or on this site.
9. Third-party services
If you connect Vlozi to a third-party service (messaging apps, social platforms, a custom domain, an email or analytics provider), your use of that service is governed by its own terms. We are not liable for its outages, policy changes or data handling.
10. Warranty disclaimer
Vlozi is provided as is and as available. We do not promise that it will be uninterrupted or error-free or fit for any particular purpose. See the status page for current status; we guarantee only what a signed agreement says.
11. Sub-processors and your data
We use the service providers listed in the sub-processors list to run Vlozi. We update that list before adding one that handles personal data, and notify customers by email at least 14 days before the change takes effect.
12. Limitation of liability and indemnity
To the maximum extent permitted by law, our total liability for any claim arising from these terms or your use of Vlozi is limited to the fees you paid us in the 12 months before the event that gave rise to the claim. We are not liable for indirect, incidental, consequential or punitive damages, including lost profits, lost data or business interruption, even if we were told they were possible. Nothing in these terms limits liability that cannot be limited by law.
You agree to defend and indemnify us against claims arising from your content, your messages and recipients, your violation of sections 4 and 6, or your breach of these terms.
13. Cancellation, termination and your data
You can cancel a plan from the dashboard at any time. Cancelling stops new charges; the current cycle's credits stay usable until it ends. Cancelling does not delete your data.
You can delete a workspace from the dashboard. A deleted workspace leaves your dashboard and its API keys stop working, and it cannot be exported afterwards, so copy what you need first. Deleting it also cancels its plan and add-ons straight away, with no refund for the rest of the billing period; if the plan can't be cancelled, the workspace is not deleted. To have the data erased, email privacy@vlozi.app; within 30 days we tell you what we erased and what we could not. [Its data is permanently erased 90 days after deletion, unless the law requires us to keep it.] See the Privacy Policy and data retention schedule for what is kept and for how long. We may terminate for unpaid invoices, serious or repeated breach of these terms, or legal compulsion; termination notices go to the email on your account.
14. Governing law and disputes
These terms are governed by the laws of India. The courts in Azamgarh, Uttar Pradesh, India have exclusive jurisdiction. Before filing anything, please email us.
15. Changes to these terms
We will email material changes at least 14 days before they take effect. Using Vlozi after the effective date means you accept them. Minor clarifications are posted on this page with the date updated.
16. Transfer of these terms
We may transfer these terms, and the service, to another person or company that takes over running Vlozi (for example if the business is later set up as a company). We will tell you by email at least 14 days beforehand, and your rights under these terms continue with whoever takes over. You may not transfer your account to someone else without our written consent.
